Introduction
Welcome to Yenko Mobility! By accessing or using our e-bike services, you agree to comply with and be bound by these terms and conditions. These terms govern your use of our services, including our website and mobile app, and apply to all users, including students, faculty, and other authorized personnel who utilize our e-bikes on campuses in Ghana. If you do not agree with these terms, you should not use our services.


Service Use Eligibility
To use Yenko Mobility’s e-bike services, users must meet the following eligibility criteria:

  • Eligibility Criteria: Users must be registered students or authorized personnel of institutions where our e-bike services are available. Authorized personnel may include staff, faculty, and other individuals granted access by the university or partner organizations.
  • Age Requirement: Users must be at least 18 years old to rent, operate, or use an e-bike. Users under the age of 18 are not permitted to rent or operate our e-bikes without adult supervision, and such usage may be subject to additional terms.
  • Compliance with Regulations: Users agree to abide by all campus traffic regulations, road safety guidelines, and local laws while operating the e-bikes. Users must ensure they are familiar with the rules and regulations governing bike use within the designated campus areas.

Rental Process
Our e-bikes are available for rent through the Yenko Mobility mobile app or website. The rental process is designed to be user-friendly, transparent, and secure.

  • Booking and Payment: Users can rent e-bikes by selecting a preferred bike through our app . Payment must be made in full prior to the start of the rental. We offer both subscription-based plans (monthly or annual) and a pay-per-ride model. The pricing structure for each option will be clearly outlined during the booking process.
  • Rental Duration and Fees: Rental durations vary depending on the user’s needs, with standard options such as hourly or daily rentals. Rental fees will be displayed before confirming the booking. Additional charges, such as late return fees, will be disclosed at the time of booking.
  • Payment Methods: We accept multiple payment methods, including local mobile money services (MTN MoMo, TCash), credit/debit cards, and other secure payment systems.

User Responsibilities
As a user of Yenko Mobility’s services, you have certain responsibilities to ensure the safety and proper operation of the e-bike:

  • Care and Operation: You are responsible for the safe operation of the e-bike during the rental period. This includes riding the bike safely, adhering to all traffic laws, and ensuring the bike is operated in a manner that does not cause harm or damage to yourself or others.
  • Helmet Use: While helmets are not mandatory, we strongly recommend wearing one during all rides. Users are responsible for providing their own helmet, or they may opt to rent one from our service providers, where available.
  • Parking: E-bikes must only be parked in designated parking areas. Unauthorized or improper parking, such as leaving e-bikes in non-designated spaces or blocking walkways, may result in penalties, including fines and suspension of service access.
  • Conduct: Users must refrain from any activities that could endanger themselves, others, or the e-bike. This includes reckless riding, tampering with the bike’s components, or using the bike for unauthorized purposes.

Liability
Yenko Mobility prioritizes the safety of our users but cannot assume liability for certain risks involved with using e-bikes.

  • Assumption of Risk: By using our services, you acknowledge and accept all inherent risks associated with operating an e-bike, including, but not limited to, accidents, injuries, or damage caused by collisions, falls, or mechanical failure.
  • Responsibility for Damage: You are responsible for any damage that occurs to the e-bike during the rental period. If the e-bike is damaged or lost, you may be required to pay for repairs or replacement costs, as determined by Yenko Mobility after an assessment of the damage.
  • Exclusions of Liability: Yenko Mobility is not liable for any indirect, incidental, or consequential damages, including loss of data, loss of income, or business interruptions, arising from your use of our e-bikes.

Cancellations & Refunds
We understand that plans can change, and we offer a flexible cancellation and refund policy:

  • Cancellations: Users may cancel their rental bookings up to 24 hours before the scheduled rental time for a full refund. Cancellations made after this period may incur a cancellation fee, depending on the circumstances.
  • Refunds for Incomplete Rides: Refunds will not be provided for rides that are incomplete due to user fault, including but not limited to, early returns or failure to properly lock the bike.
  • Technical Issues: In the event that the e-bike experiences a technical malfunction, users should report the issue immediately via our mobile app. Yenko Mobility will assess the issue, and if it’s deemed a technical fault on our end, a refund or ride credit will be issued.

Termination of Use
Yenko Mobility reserves the right to terminate or suspend any user’s access to our services under the following conditions:

  • Violation of Terms: If a user violates any part of these terms and conditions, engages in unlawful behavior, or uses the service in a manner inconsistent with the purpose of the e-bike rental.
  • Misuse of Equipment: Engaging in reckless riding, tampering with e-bike components, or failure to comply with safety or parking regulations may result in the suspension or termination of your account.
  • Failure to Pay: Users who fail to pay for rentals or accumulated fees may have their accounts suspended or terminated.

Changes to Terms
We reserve the right to update or modify these terms and conditions at any time. Any changes will be clearly posted on our website and app:

  • Notification: Significant changes to the terms will be communicated to users via email or app notifications. By continuing to use our services after these changes, you agree to the updated terms.
  • Review: We encourage users to periodically review these terms to stay informed about our policies.

Governing Law
These terms and conditions are governed by the laws of Ghana. Any legal disputes arising from the use of Yenko Mobility’s services shall be resolved within the jurisdiction of Ghanaian courts.


Rental Law
In addition to our terms, we adhere to relevant laws governing rental agreements:

  • The Rent Act of 1963 (Act 220): This act provides the legal framework for rental services in Ghana, including but not limited to agreements, responsibilities, and penalties associated with rental transactions, which also apply to our e-bike rental services.
